dunno really wat the rules are except i dont beleive they should have the authority to confiscate cars indefinatly,ie 3rd strike i think it is,thats just bull$hit,yea i know you shouldnt get upto that much but some cops out there do have an attitude problem and tend to pick on certain individuals,i have been part off this problem a couple years ago as most people on here have gone through the same....

I think unless the coppers catch you in the act its to bad..

Some aspects of the law are fair and reasonable, but other parts are crap - esp the dob in a hoon thing without reasonable evidence - too many people who are jealous of other peoples cars will be using this one to manipulate the situation. Will be very interesting to see how it will hold up in court.

But yeah i have no problem with the street racing stuff, burnouts in the main street and the like ... seen too many people do dumb stuff like that on a saturday morning in amongst all the shoppers - and I reckon they should lose their car for that kinda crap.

The big issue will be how the courts handle it and what measure the police use to set their standards.

i reckon that to nat what happens if your car is parked down a back street somebody takes a photo,goes home and photoshops a whole heap of smoke into it,if they are really good how can you tell the difference???

worst thing is if u wanna fight it by the time u drag it through courts and all that u would have gotten ya car back ( unless 3rd time unlucky ), to me thats the worst bit they can take me license, give me a fine but dont touch me car

Is the states road toll down now the police have such a firm handle on drivers doing the wrong thing??

If someone is doing stupid things in the wrong place yeah fair enough. But if some one have made the effort to distance themselves from unknowing public, leave them alone!

They need to remember they were young once too.... And the best way to learn is by experience!

ROAD TRAFFIC ACT 1974
Hoon Amendments
Commencement Date 01 May 2007



The above Act has been amended by the Road Traffic Amendment Bill 2006. All Officers are to be aware of the following changes that affect “Hoon” offences.

· Section 78A- Reckless charges that involve speeding by 45km/h or more will now be impounding offences when dealt with by way of section 60(1a) or (1b).

· Section 78A- “Senior Officer” definition regarding notification by the impounding officer has been amended to mean only those members who have obtained the rank of Inspector or higher regardless of where the impounding offence occurs.

· Section 5(6)-The requirement for a Police Officer to personally witness an impound offence has been removed. An Officer must be able to show reasonable grounds for believing the substantive offence has occurred before an impound takes place.

· Procedural amendments to payment provisions have been made and will require payment before the vehicle is released, unless exceptional circumstances exist. NOTE: The current procedures of releasing a vehicle without payment will remain in place until Finance Directorate have completed guidelines.

I have made the text Red above of the part that refers to public evidence - it merely states that an officer does not have to witness the event but MUST have reasonable grounds to believe the offence took place.

Coppers should be very wary of hearsay evidence and on the whole will always try to get both sides of a story. The evidence they see by way of photos or video must be good enough to identify the vehicle, driver's behaviour and place of the activity. If an officer is only offered verbal evidence he has to be absolutely sure of the accuracy and he would interview the suspect before laying charges.



apparently this was posted by a copper so maybe its not gonna be as easy as just dobbing someone in.

just pic ya places to have fun simple . if your gonna do burnouts an go stupid in or close to town i hope you get caught . i have gone 8 years without losing a point an only been pulled over for rbt's etc.
